Accessibility Statement
Manhattan By Sail is committed to making our services available to everyone, including those with disabilities. We actively work to make sure our website is compliant with the World Wide Web Consortium’s Web Content Accessibility Guidelines (WCAG) 2.1 and are actively engaged in improving our content and presentation of it. On an ongoing basis, we will have periodic website accessibility audits, as well as end-user accessibility testing and evaluation of our website, conducted in order to ensure conformance with WCAG 2.1.
Public Sails
In the event of a cancellation by the Captain of the Clipper City or Shearwater due to severe weather conditions customers will be rescheduled at no additional fee. Refunds are not offered.
If you wish to reschedule your sail, the following policy applies:
- Up to 48 hours prior to departure time, customer may call to reschedule, based on availability, at no additional charge. 212.619.0907.
(72 hours for groups of 10 people or more; 1 week notice for groups of 20 or more) - Within 48 hours, payment of a per person surcharge* (based upon the type of sail) is required.
- MBS must be informed of a reschedule no less than 4 hour before departure time or customer will forfeit the fully paid value of their reservation.
MBS reserves the right to release reserved space 10 minutes prior to departure if customer has not yet checked in at boarding location service desk.
While sailing is an all weather activity, Manhattan by Sail may need to cancel unexpectedly due to severe or unsafe conditions. In this case, MBS will do it’s best to cancel at least one hour before departure time.
In the event that Manhattan by Sail cancels a sail due to mechanical failure, customers will be allowed to reschedule their reservation (at no extra charge, and subject to availability), receive a sailing credit for a future sail (for the current or following season), or receive a refund (less any rescheduling fees already charged).
If it becomes necessary to procure or provide medical assistance for the passenger, regardless of cause, all such expenses will be paid by the passenger. Authority is hereby granted without limitation to Manhattan by Sail Inc. and its affiliates (MBS) in all medical matters to order treatment or medical intervention for the passenger.
Passenger, by entering the premises of and/or accepting transit aboard a vessel owned or operated by MBS, acknowledges that (s)he is riding on a working sailboat that has inherent dangers associated with it and hereby exempts and releases MBS, their officers, members, agents, servants and employees from all liability and responsibility for personal injury, property damage or wrongful death however caused, including, but not limited to, product defect or the negligence of the released parties.
Any claim of damage shall be governed by Federal Maritime law. In any action against MBS, or its officers, members, agents, partners, employees, or servants which results in a judgment, decree, order, stipulation or settlement substantially upholding MBS’s position, the adversarial party shall reimburse MBS attorney’s fees, court costs and expenses.

Private Charters
In consideration of a private charter reservation and the payment of the appropriate fees, Manhattan by Sail Inc. agrees to reserve a vessel and to hire captains and crew.
A $1,000 non refundable fee is deemed earned upon placing a hold for desired date and time. Full payment is due one month prior to the charter date unless agreed on beforehand on a case by case basis. It is understood that in every circumstance Manhattan by Sail, Inc requires full payment prior to departure. The Vessel will not depart the dock unless full payment has been received. In the event of a cancellation by the Captain of the vessel due to severe weather conditions or mechanical failure, the Charterer will be offered three (3) alternative dates prior to the end of the current season to reschedule at no additional charge. Refunds are not offered. Catered goods are the property of the Charterer and must be paid for prior to the charter date. In the event of a postponement, catering can be delivered within Manhattan at no additional cost. Severe weather is determined solely by the Captain of the vessel.
Charterer’s requests for rescheduling will be considered on a case by case basis and are subject to a rescheduling fee which is calculated as up to 50% of the total charter costs excluding taxes.
